Welcome to the Laelith Platform (referred to as “the Laelith Platform,” “we,” “us,” or “our”), which includes but is not limited to various websites, discussion servers, forums, and other online services operated by Les bâtisseurs de Laelith association ("The Laelith Builders" association). By accessing or using the Laelith Platform, you agree to comply with and be bound by the following Terms of Use. Please read these terms carefully, as they govern your use of the Laelith Platform, including any content creation or publication. If you do not agree to these terms, please do not use the Laelith Platform.

1. Acceptance of Terms

By accessing or using any part of the Laelith Platform, you agree to comply with and be legally bound by these Terms of Use, including all policies referenced herein. These Terms apply to all users of the Laelith Platform, including users who are also contributors of content, information, and other materials.

2. User Eligibility

You must be at least 18 years old to use the Laelith Platform. By using the Laelith Platform, you represent and warrant that you are at least 18 years of age, or if you are under 18 years old, that you have obtained the consent of your legal guardian to use the Laelith Platform.

3. User Accounts

To access certain features of the Laelith Platform, including content creation and publication, you may be required to create a user account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account login details and for any activities that occur under your account.

4. User-Generated Content

The Laelith Platform allows users to create, publish, and share content, including but not limited to text, images, videos, 3D models, and other materials (collectively, "User-Generated Content"). By submitting User-Generated Content, you grant the Laelith Builders association a worldwide, non-exclusive, perpetual, royalty-free license to use, modify, reproduce, distribute, and display your content in connection with the operation and promotion of the Laelith Platform.

4.1 Content Ownership

You retain ownership of all intellectual property rights in the User-Generated Content you create and submit to the Laelith Platform. However, by submitting such content, you grant us the rights as outlined in this section, allowing the Laelith Builders association to use your content for the purposes of operating, promoting, and improving the Laelith Platform.

4.2 Content Guidelines

You agree that you will not submit or upload content that:

  • Is illegal, offensive, defamatory, or otherwise violates any laws.
  • Infringes on the intellectual property rights or privacy of others.
  • Contains viruses, malware, or other harmful elements.
  • Violates the community standards and guidelines of the Laelith Platform.
  • Contains your own personal information, unless you have a valid business reason to submit such information and have consulted with legal counsel beforehand. Personal information is governed by the Laelith Platform Privacy Policy.

The Laelith Platform reserves the right, at its sole discretion, to change, modify, or remove any User-Generated Content that does not comply with these Terms of Use or is otherwise deemed inappropriate. This action may be taken without prior notice to you, and the decision to alter or remove content is final and non-negotiable.

4.3 Automated and AI-Based Processing

By submitting User-Generated Content, you also grant the Laelith Builders association the right to process your content using automated tools, including but not limited to database indexing and AI-based processing. This may include analysis for content optimization, categorization, moderation, or other operational improvements.

  • AI-based tools may be used to identify content trends, improve search functionality, or suggest relevant content to users.
  • AI-based tools may be used to create derivated content from User-Generated Content, for example when answering to other users in AI-based chats or when generating new content such as adventures, stories, character backgrounds, description of places, images, etc.
  • The Laelith Builders association does not claim ownership over the User-Generated Content but reserves the right to process it using such technologies to enhance the platform's functionality and user experience.

5. Online Discussion Activities

The Laelith Platform offers various online discussion services, such as chat servers, forums, and other community spaces (including, but not limited to, services like Discord), where users can interact with each other. These discussion spaces are intended to foster constructive, respectful conversations within the Laelith community. By participating in any online discussions on the Laelith Platform, you agree to the following behavior guidelines:

5.1 Respectful Conduct

You are expected to interact respectfully with other users at all times. This includes, but is not limited to:

  • Treating others with courtesy, respect, and kindness, regardless of their opinions or viewpoints.
  • Avoiding offensive, abusive, or harmful language, including hate speech, personal attacks, harassment, bullying, or any form of discriminatory behavior based on race, gender, sexuality, religion, disability, or any other protected characteristic.
  • Refraining from trolling, spamming, or deliberately disrupting discussions with inflammatory or off-topic comments.

5.2 Zero Tolerance for Harassment

The Laelith Platform has a zero-tolerance policy for harassment of any kind. This includes:

  • Unwanted personal messages, advances, or any form of intimidation.
  • Sharing or threatening to share another user's private or personal information without consent (doxxing).
  • Targeted abuse or repeated harassment towards any individual or group.
  • Any form of harassment will result in the immediate suspension or termination of your access to the Laelith Platform, including any chat services.

5.3 Moderation and Reporting

To maintain a safe and welcoming environment, the Laelith Platform reserves the right to monitor and moderate discussions on its services. Moderators may take actions, including but not limited to, removing inappropriate messages, issuing warnings, muting or banning users, or terminating access to the platform for individuals who violate these guidelines.

If you encounter any behavior that violates these Terms of Use, you are encouraged to report it to the Laelith Platform's moderation team. All reports will be handled confidentially, and appropriate action will be taken at the discretion of the Laelith Platform.

5.4 Personal Responsibility

While the Laelith Platform provides community guidelines and moderation, you are solely responsible for your own behavior in online discussions. Be mindful of your words and actions, as the online chat services are public spaces where your comments and interactions are visible to others. Any consequences arising from your participation in discussions, including legal liability, remain your responsibility.

5.5 Third-Party Chat Platforms

If you participate in Laelith Platform-related discussions on third-party services (such as Discord), you are subject to both these Terms of Use and the terms and policies of the third-party service. The Laelith Builders association cannot be held responsible for any actions taken by third-party service providers, but reserves the right to take action on the Laelith Platform for behavior occurring within those services that violates these Terms of Use.

6. Blockchains and Cryptographic Technologies

The Laelith Platform may incorporate or interact with blockchain and cryptographic technologies, including but not limited to Non-Fungible Tokens (NFTs) and other decentralized digital assets. By participating in any blockchain-related activities on the Laelith Platform, you agree to the following terms:

6.1 Blockchain and NFT Overview

Blockchains are decentralized ledger systems that record transactions securely using cryptographic technology. Non-Fungible Tokens (NFTs) are unique digital assets that represent ownership or proof of authenticity of digital content, which may include artwork, music, collectibles, and other digital goods. These assets are typically stored on blockchain networks, such as Ethereum or similar systems.

The Laelith Platform may facilitate interactions with NFTs or other blockchain-based assets, but does not act as a marketplace or directly handle the transfer or sale of such assets unless explicitly stated.

6.2 Ownership and Responsibility

If you create, buy, sell, or otherwise engage with NFTs or other blockchain assets on the Laelith Platform or through associated services:

  • You acknowledge that the ownership of such assets is secured through blockchain technology and is decentralized, meaning that the Laelith Platform cannot modify, delete, or otherwise interfere with transactions conducted on the blockchain.
  • You are solely responsible for any transactions involving NFTs or blockchain assets, including ensuring the validity, legality, and authenticity of any digital assets you engage with.
  • The Laelith Platform is not responsible for any losses, damages, or disputes arising from blockchain transactions, including but not limited to, wallet security breaches, failed transactions, or lost private keys.

6.3 Wallets and Security

To participate in blockchain-related activities on the Laelith Platform, you may need to connect a digital wallet ("Wallet") to the platform to store, manage, or interact with NFTs and other blockchain assets. It is your sole responsibility to secure and protect your Wallet and any associated private keys, passwords, or recovery phrases.

  • Never share your Wallet credentials with anyone, including your private key or recovery phrase. Sharing your Wallet information can result in unauthorized access to your assets, and the Laelith Platform cannot recover or reverse such transactions.
  • The Laelith Platform does not store or manage your Wallet credentials, and any interactions with blockchain networks occur via decentralized services. As such, the Laelith Builders association is not liable for any loss, theft, or compromise of your Wallet or its contents.
  • You are responsible for ensuring the security of the device or software used to access your Wallet, including using proper encryption, two-factor authentication, and safeguarding against malware or phishing attacks.

6.4 Risks of Blockchain Technology

By engaging with blockchain-based assets or NFTs on the Laelith Platform, you acknowledge and accept the inherent risks associated with blockchain technologies, including:

  • The potential for significant fluctuations in the value of digital assets.
  • The decentralized nature of blockchain technology, which means transactions may be irreversible and cannot be mediated or reversed by the Laelith Platform.
  • The evolving legal and regulatory environment surrounding cryptocurrencies and NFTs, which may impact your rights or obligations related to such assets.

You agree that the Laelith Platform shall not be liable for any financial or legal risks, losses, or damages arising from your engagement with blockchain technology or NFTs.

6.5 Prohibited Uses

You agree that you will not engage in any activities related to blockchain assets or NFTs on the Laelith Platform that:

  • Violate any applicable laws or regulations, including but not limited to anti-money laundering (AML) laws and securities regulations.
  • Involve the creation, distribution, or sale of digital assets that are fraudulent, misleading, or infringe upon the intellectual property rights of others.
  • Promote or engage in speculative or deceptive practices related to NFTs or blockchain technologies.
  • Use NFTs or blockchain assets as a means of conducting illegal activities, including but not limited to tax evasion or the laundering of illicit funds.

6.6 Intellectual Property and NFTs

Ownership of an NFT on a blockchain does not necessarily convey ownership of the intellectual property rights of the underlying digital content represented by the NFT, unless explicitly stated. You may only use, reproduce, or display the digital content associated with an NFT in accordance with the rights and licenses granted to you at the time of purchase. Any use beyond the scope of these rights is strictly prohibited.

6.7 Environmental Considerations

Many blockchain networks, including those used for NFTs, consume significant amounts of energy to secure transactions. You are encouraged to consider the environmental impact of participating in blockchain-based activities and to seek out sustainable or energy-efficient networks where possible.

6.8 Third-Party Blockchain Platforms

The Laelith Platform may enable interactions with third-party blockchain networks or platforms, such as cryptocurrency exchanges, NFT marketplaces, or decentralized applications (DApps). When using such third-party services, you agree to abide by their terms and conditions, and you acknowledge that the Laelith Builders association is not responsible for any actions or transactions conducted on these third-party platforms.

6.9 Changes to Blockchain and NFT Features

The Laelith Platform reserves the right to modify, suspend, or discontinue any blockchain-related features or functionalities at any time, without notice or liability. This includes the integration of NFTs or other cryptographic assets, as well as the use of specific blockchain networks.

7. Prohibited Activities

You agree that you will not engage in any activity that:

  • Violates any laws or regulations.
  • Attempts to interfere with or compromise the security or proper functioning of the Laelith Platform.
  • Involves the unauthorized use of any content or information available on the Laelith Platform.
  • Attempts to collect personal data from other users without their consent.

8. Termination of Use

We reserve the right to suspend or terminate your access to the Laelith Platform at our sole discretion, with or without notice, if you violate these Terms of Use or engage in any activity that harms the Laelith Platform or its users.

9. Intellectual Property

All content and materials available on the Laelith Platform, including but not limited to the design, text, graphics, logos, and software, are the property of the Laelith Builders association or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Laelith Platform without the express written permission of the Laelith Builders association.

User-Generated Content submitted to the Laelith Platform remains the property of the user who created it. However, by submitting content, you grant the Laelith Builders association the rights outlined in Section 4, allowing the use of your content for the operation and promotion of the Laelith Platform.

10. Disclaimers

The Laelith Platform is provided on an 'as is' and 'as available' basis. We make no warranties, express or implied, as to the operation of the Laelith Platform, its content, or any User-Generated Content. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, the Laelith Builders association, its affiliates, and its licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Laelith Platform or any content published on the Laelith Platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Laelith Builders association, its affiliates, licensors, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Laelith Platform.
  • Any User-Generated Content you submit, post, or share on the Laelith Platform.
  • Your violation of these Terms of Use or any applicable law or regulation.
  • Any infringement of third-party rights by your User-Generated Content.

13. Modifications to the Terms of Use

We reserve the right to modify these Terms of Use at any time. If changes are made, we will notify users by updating the 'Last Updated' date at the top of this page. Your continued use of the Laelith Platform after any such changes constitutes your acceptance of the revised terms.

14. Governing Law

These Terms of Use and any disputes arising out of or related to your use of the Laelith Platform will be governed by and construed in accordance with the laws of the State of Washington, USA.
